Do I need to register my trademark or is using it enough?

Using a mark does give you some rights, but registration puts you on far stronger ground. A registered trademark is easier to enforce, gives you nationwide protection and serves as public notice that the brand is yours. Most disputes are simpler to win when the mark is on the register.

If there are no objections or oppositions, registration usually takes around a year to eighteen months. The mark can be used with the TM symbol as soon as the application is filed, so you are not left unprotected while it moves through the Registry.

A search checks whether a name or logo similar to yours already exists on the register. Doing this before you file saves you from investing in a brand that may later be objected to or opposed. It is the single most useful step before an application.

An objection is not the end of the application. It means the Registry has raised a query, often about similarity to an existing mark or the distinctiveness of yours. A well drafted reply, filed in time, addresses those concerns and moves the application forward. We prepare and file these responses regularly.
